Terms and Conditions

§ 1 Scope

These Terms and Conditions apply to all business relations between me, Victoria Chollenti, and you as my customer that are initiated through my website chollenti.com or by email.

The version of these Terms in force at the time of your enquiry or order shall apply.

I do not accept differing terms on your part unless I have expressly agreed to them in writing.

§ 2 My products & presentation

I offer hand-crocheted bags, made in part from recycled material (upcycling).

There are two ways to get your CHOLLENTI:

Made to order: The bag is crocheted by hand especially for you, according to your choice of model, colours and details, only after your binding order and payment.

Ready-made single pieces: I crochet on my own and in small quantities. Alongside the made-to-order pieces, individual bags are finished from time to time. I offer these under „Direkt mitnehmen“ (take it home) – they are available immediately and each exists only once. How many pieces are available therefore changes constantly; often there are only a few.

The presentation of the models on my website is not a legally binding offer, but an invitation for you to send me a non-binding enquiry. This does not apply to the ready-made single pieces – those you can purchase directly.

§ 3 How a contract comes about

For a made-to-order bag the process is personal and individual:

Your enquiry: You send me a non-binding enquiry about your preferred model through my contact form or by email.

My offer: I check my capacity and send you a binding offer by email. It states the price, the shipping costs (if applicable) and the expected delivery time for your individual piece.

Conclusion of contract: The contract is concluded once you accept my offer and pay the full amount in advance by bank transfer. With your payment you also confirm these Terms.

For a ready-made single piece you can buy directly:

Order: You select the piece under „Direkt mitnehmen“ and complete the purchase on the payment page of my payment provider, where you enter your billing and delivery details.

Conclusion of contract: The contract is concluded upon successful payment. You will then receive a confirmation by email. By completing the purchase you also confirm these Terms.

§ 4 Prices & payment

My prices are fixed prices in euros.

Small business exemption: Pursuant to § 6 (1) no. 27 of the Austrian VAT Act (UStG) I do not charge value added tax and therefore do not show it.

Payment for made-to-order bags: Advance payment by bank transfer. Please transfer the amount within 7 days of receiving my offer. If payment is not made in time, I am no longer bound by my offer.

Payment for ready-made single pieces: Payment is handled by the payment provider Stripe. Which payment methods are available is shown during checkout. Your payment details are processed exclusively by Stripe – I do not receive any card details.

§ 5 Shipping costs & customs

Shipping within Austria: I cover the shipping costs for you. Delivery is free of charge.

International shipping: I ship worldwide. For deliveries outside Austria you as the buyer bear the shipping costs. I calculate these individually and state them to you in advance.

Customs: For deliveries to non-EU countries, additional duties or fees may apply, which you pay directly to the authorities there. I have no influence on these costs.

§ 6 Delivery & production

As I crochet each made-to-order bag individually for you, the delivery time begins only once your payment has been received in full.

I will state the estimated delivery time in my offer. Please bear in mind that exclusive handwork takes time.

Ready-made single pieces are already finished. They are dispatched as quickly as possible after receipt of payment, usually within a few working days.

I am not liable for delays caused by the shipping service provider (e.g. the postal service).

§ 7 Right of withdrawal

Ready-made single pieces: For already finished pieces from the „Direkt mitnehmen“ section, you as a consumer have the statutory right of withdrawal. You may withdraw within 14 days of receiving the goods without giving reasons. Sending your declaration in good time to victoria@chollenti.com is sufficient to meet the deadline. You bear the cost of returning the goods. Following a valid withdrawal, I will refund the purchase price within 14 days.

Made-to-order bags: For bags made especially for you according to your choice (e.g. colour, shape, size), there is no right of withdrawal pursuant to § 18 (1) no. 3 of the Austrian Distance and Off-Premises Business Act (FAGG).

An exchange or return simply because you no longer like the bag is therefore excluded for these made-to-order pieces, as the goods are clearly tailored to your personal requirements.

I will give you the return address once you have declared your withdrawal. Please do not send the bag back before then.

§ 8 Material & handcraft

My bags are made with care by hand from recycled T-shirt yarn.

Character of the goods: Slight variations in colour, texture or yarn thickness, as well as small irregularities in the stitch pattern, are inherent to the material and typical of upcycled products. These characteristics are not defects – they are what make your bag a genuine one-off.

Because screens are calibrated differently, there may be slight colour differences between the photos on my website and the finished product.

§ 9 Warranty & liability

The statutory warranty provisions apply.

My liability is limited to intent and gross negligence. This does not apply to personal injury.

I accept no liability for obvious typographical or arithmetical errors in my offers or on my website; I reserve the right to correct such errors.

§ 10 Final provisions

Austrian law applies. The UN Convention on Contracts for the International Sale of Goods is excluded.

Should any provision of these Terms be invalid, the remaining provisions remain unaffected.

EU platform for online dispute resolution: https://ec.europa.eu/consumers/odr. I am not obliged to participate in dispute resolution proceedings before a consumer arbitration board.

Language: These Terms are a translation of the German original. In the event of any discrepancy, the German version at chollenti.com/de/agb/ shall prevail.
